Boehner demands that Obama provide legal basis for Libya mission – TheHill.com

Speaker John Boehner (R-Ohio) warned President Obama on Tuesday that he will \"6a00d8341bf7d953ef014e60260526970c-320wi\" be in violation of the War Powers Resolution on Sunday because he has not been given congressional authorization for the military mission in Libya.

In a letter, Boehner demanded that Obama provide a legal justification for the operation by Friday. The Speaker noted that the House passed a resolution this month stating explicitly that the administration has not sought or received authorization from Congress. 

\”Therefore, it would appear that in five days, the administration will be in violation of the War Powers Resolution unless it asks for and receives authorization from Congress or withdraws all U.S. troops and resources from the mission,\” Boehner wrote.

The 1973 War Powers Resolution says that the president can only deploy U.S. military forces for 60 days without authorization from Congress. The act extends that by 30 days if the president justifies to Congress in writing that it would be unsafe to remove the forces.
