Gloucester County Grand Jury Declines to Criminally Charge Deptford Township Police Officer

Woodbury, NJ – A Gloucester County grand jury voted to not file criminal charges at the conclusion of its deliberations on February 18, 2026 regarding the non-fatal  police-involved shooting of Jeffrey Jaworski of Sewell, New Jersey, on November 28,  2024 in Deptford, New Jersey, after an encounter with members of the Deptford  Township Police Department. 

Sergeant David Grogan’s non-fatal use of deadly force was investigated by the  Gloucester County Prosecutor’s Office (GCPO) and supervised by the NJ Attorney  General’s Office of Public Integrity and Accountability. The investigation was  presented to Gloucester County residents serving on a county grand jury, in  accordance with the New Jersey Attorney General’s Office’s 2019 Independent  Prosecutor Directive (the “Directive”). In July 2021, the Office of Public Integrity  and Accountability issued Standard Operating Procedures (SOPs) to ensure such  grand jury presentations are conducted in a neutral, objective manner, with  appropriate transparency regarding the process, consistent with the Directive. 

The investigation included interviews of witnesses, collection and review of body  worn camera footage and 911 audio recordings, physical evidence collected by the  Gloucester County Prosecutors Office’s Crime Scene Unit, photographs, and  ballistics evidence that had been examined by personnel from the New Jersey State  Police Firearms Unit. This evidence, along with recorded interviews given by the  Deptford Township police officers was presented to the grand jury. After hearing  testimony and reviewing the evidence, the grand jury concluded its deliberations

with a finding that Sgt. Grogan’s non-fatal use of deadly force was justified and, as  a result, no criminal charges would be issued. 

According to the investigation, on November 28, 2024, in Deptford Township,  several officers responded to the Fairfield Inn for a report that several occupants of  a room had not paid and would not vacate. Police officers arrived and knocked on  the door in an attempt to speak with the occupants. One of the occupants, Jeffrey  Jaworski, jumped out the window and fled into a wooded area behind the hotel.  Officers pursued him on foot at which time Jaworski yelled out at officers that he  had a gun. Sgt. Grogan discharged his weapon, striking Jaworski in the buttocks. Jaworski continued to run onto nearby State Highway 42 where he was ultimately  apprehended and taken to the hospital. He was treated and released several days  later. 

A conflicts check was conducted pursuant to the Directive, and no actual or  potential conflict of interest was found involving any individual assigned to the  investigation. Prior to presentation to the grand jury, the investigation was  reviewed by personnel of the New Jersey Attorney General’s Office’s Fatal Police  Encounters Unit, in accordance with policies and procedures established for these  presentations. The matter was presented to the grand jury by Gloucester County  First Assistant Prosecutor Dana R. Anton. 

At the conclusion of these investigations, pursuant to the Directive and SOPs, OPIA  determines whether any principal should be referred to the appropriate law  enforcement agency for administrative review in accordance with the Attorney  General’s Internal Affairs Policy & Procedures. OPIA monitors any resulting review  and takes such actions as are necessary to ensure that the review is completed in a  timely fashion, and that appropriate actions are taken based on the results of the  review.
